Can you get a real estate license with a DUI? The answer is yes, it’s possible, but it may not be possible for you. Whether or not you will be able to get a real estate license with a DUI and start your real estate career will be dependent on several factors.

For starters, the state where you’re seeking your real estate license will make a big difference. Each application is viewed on a case by case basis in that particular state.

For example, in Michigan, to get your real estate license you need to be of “good moral character”. Therefore, a conviction or a DUI doesn’t automatically preclude you from obtaining your Michigan real estate license.

In California, according to an attorney on NOLO, you will be prevented from obtaining your real estate license if you have two or more DUIs. A California resident can still get their California real estate license if they have one DUI.

Is It Possible to Get A Michigan Real Estate License With DUI?

Becoming a Michigan real estate agent is possible, even if you have a DUI.

You’re required to disclose any convictions and supporting information when you apply for your Michigan real estate license.

Once submitted, the Licensing and Regulatory Affairs (LARA) office will review your information and your case.

They are looking to see if you meet their good moral character standards. You’re able to request a preliminary determination to see if your case would prevent you from getting your Michigan real estate license.

This will save you the time of taking your real estate exam, only to find out that your application is rejected.

Here is what LARA is often looking at when they are considering your license:

  • The amount of time that has passed since the conviction
  • Is there a repeat pattern of behavior and DUIs
  • Is there evidence of rehabilitation

At the end of the day, each situation is unique and it will be up to LARA to determine if you can get your real estate license.

What Happens If The State Accepts My Application?

If your state has agreed to accept your application, then you can proceed with getting your real estate license. Register for your state’s real estate exam and set up your license with your sponsoring real estate broker.

If you don’t yet know the real estate brokerage you want to work for, that’s okay. You can still take the exam and find a brokerage later.
